Investigations

 

Because it is our mission to proactively prevent lawsuits, one strategy we advise our clients to implement is to anticipate, well in advance, the inevitability of employee complaints and misconduct. Then, determine, in advance, what actions they will take to ensure that the anticipated internal complaint does not spiral into a lawsuit. 

  • What will you do when an employee makes a complaint about another employee’s discriminatory, harassing or abusive behavior? 
  • What can the company do when the company suspects an employee of wrongdoing or misconduct? 

In these circumstances, the proactive solution is for the company to conduct a fair, impartial and thorough investigation into the alleged misconduct before determining the disciplinary response.  In California, it is required by law.  According to the California Supreme Court, upon receipt of complaints about an employee, an employer can terminate that employee for cause when it acts "in good faith and bases its decision on an honest assessment of the facts after an appropriate investigation. Cotran v. Rollins Hudig Hall International, Inc. 17 Cal. 4th 93 (1998).   

How we can help:

  • First, we can assist you in implementing a clear investigation protocol policy. 
  • Second, we can train your managers and human resources to intake complaints correctly. 
  • Third, we can train your human resources to conduct the investigation.
  • Fourth, in the alternative to your conducting the investigation in house, we can conduct the investigation for you.  We will provide you, in a timely manner, the declarations of parties, witnesses and evidence reviewed.  We can also provide you with a recommendation as to appropriate disciplinary measures in light of the circumstances.
  • Last, we can refer you to an excellent litigation attorney to discuss potential litigation issues without compromising our impartiality as the investigator/ consultant. 

We recommend you bring us in as "outside neutral investigator" when:

  • The person being investigated is in a high ranking position.
  • No one has been trained to conduct investigations in house.
  • Someone in HR is being accused of wrongdoing or may be perceived as biased or partial.
  • Your investigator or HR is just too busy to devote all of their attention and time to
    this time-sensitive matter.

Remember, that it is proactive and forward thinking to anticipate that this matter may lead to litigation.  Therefore, you can rely on our expertise and neutrality as the outside investigator to ensure that the investigation withstands scrutiny and the investigator is a credible witness in your defense.
